(1) Conditions of participation
These conditions of participation regulate the conditions for participation in the competition for the 1st birthday of the online store of Centa-Star Bettwaren GmbH & Co KG, hereinafter referred to as the operator or organizer, as well as any necessary transfers of rights. The organizer of the competition is Centa-Star Bettwaren GmbH & Co KG, Augsburger Str. 275, 70327 Stuttgart. Participation in this competition is free of charge and is governed exclusively by these conditions of participation. Participation in the competition constitutes acceptance of these conditions of participation.
(2) Participation in the competition
The competition ends on August 31 at 11:59 pm. Participants can enter the competition up until this time by submitting at least their email address on the registration page at www.centa-star.com/gewinnspiel-geburtstag. Participation is only possible within the participation period. Entries to the competition received after the closing date will not be taken into account when determining the winners.
Participation in the competition is free of charge. The competition is only available to customers of the organizer who have placed at least one order in the Centa-Star online store by the end of the competition. A prerequisite for participation is consent to the collection and storage of data for the purpose of running the competition.
(3) Eligible participants
Natural persons resident in Germany who have reached the age of 18 are eligible to participate.
If a participant has limited legal capacity, the consent of their legal representative is required.
All persons involved in the design and implementation of the competition and employees of the organizer and their family members are not eligible to participate in the competition. In addition, the operator reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons, for example
(a) in the event of manipulation in connection with access to or execution of the competition,
(b) in the event of breaches of these conditions of participation,
(c) in the event of unfair trading or
(d) in the event of false or misleading information in connection with participation in the competition.
(4) Winning, notification and transfer of the prize
On September 25, a total of three people will be drawn from all eligible participants to receive a full refund of the price of their purchase in the Centa-Star online store.
After the end of the competition, the winners will be selected from all eligible participants who have fulfilled the conditions for participation in the competition. The winners will be selected at random; each participant will only be included in the ranking once.
Only one prize is possible per participant.
The winners will be contacted by e-mail within 5 working days of the draw and requested to send an e-mail to the organizer in which the personal data (name, address, date of birth) are duly and truthfully transmitted in full. This information will only be used to send the prize.
The prize will only be handed over to the winner or the winner’s legal representative via the payment method used for the original order. It is not possible to exchange, collect or pay out the prize in cash.
Any costs incurred for the transmission of the winnings shall be borne by the operator. Any additional costs associated with claiming the prize shall be borne by the winner. The winner is responsible for any taxation of the prize.
If circumstances arise for which the organizer is not responsible, the respective winner will accept an appropriate substitute prize.
If the winner does not respond within a period of 14 days, the claim to the prize expires. In this case, the organizer is entitled to carry out a replacement draw.
(5) Exclusion
(a) A breach of these conditions of participation entitles the organizer to exclude the respective participant from participation. This applies in particular if the participant provides false information.
(b) If the excluded participant is a winner who has already been drawn, the prize may be subsequently revoked.
(6) Premature termination of the competition
The organizer expressly reserves the right to terminate a competition prematurely in whole or in part at any time, even without observing deadlines, or to change its course if it is not possible to guarantee the proper execution of the competition for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons.
(7) Data protection
The provision of personal data is necessary for the processing of the competition. The participant assures that the personal details provided by him/her, in particular first name, surname and e-mail address, are truthful and correct.
The organizer is responsible for the collection, processing and use of participants’ personal data, insofar as we process this data ourselves (e.g. shipping service providers). The personal data of participants will only be used within the framework of the statutory provisions of data protection law and only stored, processed and used to the extent that this is necessary for the implementation of the competition or if the consent of the participant has been obtained. This also includes use for exercising the rights of use granted.
In the event of a win, the winner agrees to the publication of his/her shortened name in the advertising media used by the organizer and associated companies. This includes the announcement of the winner on the websites and social media presences of the operator and those of affiliated companies.
The participant may at any time request information about the personal data stored about him/her or revoke any consent given. An informal notification by e-mail to the organizer(info@centa-star.com) is sufficient for this purpose. Once consent has been withdrawn, the participant’s personal data that has been collected and stored will be deleted immediately. (8) Applicable law
Questions or complaints in connection with the competition should be addressed to the operator. Contact details can be found in the legal notice of the organizer’s website(www.centa-star.com/shop/impressum/).
The operator’s competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
(9) Severability clause
Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic meaning and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
